By accessing or using the PUEF.AI adaptive learning platform (the "Service") provided through https://www.puef.ai and any related applications (collectively, the "Platform"), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Service.
1.1 Definitions. "PUEF.AI," "we," "us," or "our" refers to PUEF.AI and its affiliates. "User," "you," or "your" refers to the individual or entity accessing the Service.
1.2 Acceptance. By creating an account, accessing, or using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.
2.1 Age Requirements. You must be at least thirteen (13) years of age to create an account. Users under eighteen (18) years of age must have parental or legal guardian consent.
2.2 Parental Consent. By allowing a minor to use the Service, the parent or legal guardian agrees to be bound by these Terms and accepts full responsibility for the minor's use of the Service.
2.3 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use.
2.4 Account Restrictions. Accounts are personal and non-transferable. Account sharing is strictly prohibited and constitutes a material breach of these Terms.
3.1 Subscription Plans. The Service is offered on a subscription basis with pricing and terms displayed at the point of purchase.
3.2 Automatic Renewal. ALL SUBSCRIPTIONS AUTOMATICALLY RENEW at the end of each billing period unless cancelled. You authorize us to charge your payment method on file for renewal subscriptions.
3.3 Refund Policy. No Refunds. All payments are non-refundable, including partial use or failure to cancel in time, except as explicitly stated in Section 4 under the Score-Improvement Refund Policy.
3.4 Payment Processing. Payment processing is handled by third-party providers. You agree to their terms and conditions.
3.5 Failed Payments. We reserve the right to suspend or terminate access for failed payments or chargebacks.
4.1 Exclusive Remedy. If you meet every condition below (Section 4.2), PUEF.AI will refund only the subscription fee actually paid for the qualifying purchase. This refund is your sole and exclusive remedy; PUEF.AI disclaims all other liability, including incidental, consequential, or punitive damages.

4.5 Exclusions and Limitations
5.1 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes only.

6.1 Ownership. All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of PUEF.AI or its licensors and are protected by intellectual property laws.
6.2 User Content. You retain ownership of content you submit ("User Content") but grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and distribute User Content in connection with the Service.
6.3 Feedback. Any feedback, suggestions, or ideas you provide become our property without compensation to you.
7.1 AS-IS BASIS. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
7.2 No Guarantee. We do not guarantee that the Service will be error-free, secure, or uninterrupted. We do not guarantee any academic outcomes or test score improvements.
7.3 Limitation of Liability. To the maximum extent permitted by law, in no event shall PUEF.AI be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
7.4 Educational Content Disclaimer. Content provided through the Service is for educational purposes only and may contain fictional scenarios, simplified examples, or hypothetical situations that do not reflect factual information.
You agree to defend, indemnify, and hold harmless PUEF.AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
9.1 Mandatory Arbitration. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
9.2 Class Action Waiver. You waive any right to participate in a class action lawsuit or class-wide arbitration.
9.3 Venue. Arbitration shall take place in New Jersey. For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in New Jersey.
10.1 Termination by You. You may terminate your account at any time through your account settings.
10.2 Termination by Us. We reserve the right to suspend or terminate your account at any time for: (a) violation of these Terms; (b) fraudulent or illegal activity; (c) chargebacks or payment disputes; or (d) any other reason at our sole discretion.
10.3 Effect of Termination. Upon termination, your right to use the Service immediately ceases. Sections 6, 7, 8, 9, and 12 shall survive termination.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or Platform notice. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
12.1 Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and PUEF.AI.
12.2 Severability. If any provision is found unenforceable, the remaining provisions shall continue in full force.
12.3 No Waiver. Our failure to enforce any provision shall not constitute a waiver of that provision.
12.4 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
12.5 Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
12.6 Governing Law. These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict of law principles.
